1. Introduction

RyuPy respects the intellectual property rights of others and expects users of its Services to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), RyuPy will respond promptly to claims of copyright infringement that are reported in compliance with the procedures outlined below.

2. DMCA Notice Requirements

If you believe that your copyrighted work has been copied or used in a way that constitutes copyright infringement through any RyuPy application or website, please provide a written notice containing the following information:

  • Signature — A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
  • Identification of copyrighted work — A description of the copyrighted work that you claim has been infringed, including the URL or location where the original work exists, if applicable.
  • Identification of infringing material — A description of the material that you claim is infringing and its location within the RyuPy application or website, with enough detail for us to locate it.
  • Contact information — Your full name, mailing address, telephone number, and email address so that we may contact you regarding your notice.
  • Good faith statement — A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • Accuracy statement — A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the copyright owner's behalf.

3. Submitting a DMCA Notice

DMCA notices should be submitted via our contact form at https://ryupy.com/contact/. Please use the subject line "DMCA Copyright Infringement Notice" to ensure your notice is handled promptly. Upon receipt of a valid DMCA notice, RyuPy will act expeditiously to investigate and, if appropriate, remove or disable access to the allegedly infringing material.

4. Counter-Notification

If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification containing the following:

  • Signature — Your physical or electronic signature.
  • Identification of removed material — A description of the material that was removed or disabled and the location where it appeared before it was removed.
  • Good faith statement — A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Consent to jurisdiction — Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the applicable federal court and that you will accept service of process from the person who filed the original DMCA notice or their agent.

5. Repeat Infringer Policy

In accordance with the DMCA, RyuPy has adopted a policy of terminating or restricting access for users who are determined to be repeat infringers in appropriate circumstances. If a user is found to have repeatedly infringed upon the copyrights of others, RyuPy may, at its sole discretion, restrict or terminate that user's access to its Services.

6. False Claims Warning

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and legal fees incurred by the alleged infringer, the copyright owner, or the service provider. Do not submit a DMCA notice or counter-notification unless you are certain that your claim is valid.
